Refund policy

ABSORA™ Returns & Refund Policy

At ABSORA™, we want you to be completely satisfied with your purchase. This Returns & Refund Policy explains when you may return your Ultra Absorbent Microfiber Hair Towel Wrap, how returns are processed, and your rights under applicable South African consumer law.

Nothing in this policy is intended to limit, exclude or waive any rights you may have under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), or any other applicable South African law.

1. Change-of-Mind Returns

If you have simply changed your mind about your purchase, ABSORA™ may accept a return provided that:

  • The towel wrap has not been used, worn or washed.

  • The towel wrap is in its original, unused condition.

  • The product is clean and free from hair, stains, makeup, cosmetics, odours, pet hair or other signs of use.

  • Any original packaging, labels, accessories or components supplied with the product are included where reasonably possible.

  • The product has not been damaged, altered or misused.

Because the Ultra Absorbent Microfiber Hair Towel Wrap is a personal hair-use product, we reserve the right to refuse a voluntary change-of-mind return where the product has been used or is no longer in a hygienically resalable condition.

This does not affect your statutory rights regarding defective, unsafe, incorrectly supplied or otherwise non-conforming goods.

2. Online Cooling-Off Rights

Where applicable to your electronic transaction, South African law provides consumers with a statutory cooling-off right.

Under section 44 of the ECTA, a consumer may cancel a qualifying electronic transaction for goods within seven days after receiving the goods, without giving a reason and without penalty, subject to the Act's requirements and exclusions.

Where a valid cooling-off cancellation is exercised, the consumer may be responsible for the direct cost of returning the goods.

Once the returned product has been received and the applicable requirements have been satisfied, any refund will be processed in accordance with the applicable legislation.

Where the law provides a consumer with a cooling-off right, this right takes precedence over any conflicting provision in this policy.

3. Defective or Faulty Products

ABSORA™ stands behind the quality of its products.

Under section 55 of the CPA, consumers are entitled to goods that are reasonably suitable for their ordinary purpose, of good quality, in good working order and free from defects.

The CPA also provides an implied warranty of quality. Where goods fail to satisfy the applicable requirements, a consumer may have the right to return the goods within six months of delivery, without penalty and at the supplier's risk and expense, subject to the requirements of the CPA.

Depending on the circumstances and the consumer's rights, the remedy may include:

  • Repair;

  • Replacement; or

  • A refund.

The applicable remedy will be determined in accordance with the CPA.

A product will not necessarily be regarded as defective merely because it has been damaged through misuse, incorrect care, negligence, unauthorised alteration, or use contrary to the product's instructions.

4. Incorrect, Damaged or Missing Items

If you receive:

  • The wrong product;

  • A product that is materially different from what you ordered;

  • A product that arrived damaged; or

  • An order with missing items,

please contact us as soon as reasonably possible after delivery.

We may request photographs or other reasonable information to help us investigate the issue and determine the appropriate remedy.

Where the issue is attributable to ABSORA™ or the courier's handling, we will work with you to resolve the matter in accordance with applicable South African law.

Please retain the original packaging until the matter has been resolved, particularly where the product arrived visibly damaged.

5. How to Request a Return

To request a return, please contact ABSORA™ using the contact details provided on our website.

Please include:

  1. Your full name;

  2. Order number;

  3. Date of purchase;

  4. Reason for the return;

  5. Photographs or video where relevant; and

  6. Any other information reasonably required to assess the request.

Do not send a product back without first contacting us and receiving return instructions.

Unauthorised returns may cause delays in processing.

6. Return Condition & Inspection

All returned products may be inspected upon receipt.

For voluntary change-of-mind returns, the product must remain unused, clean and in a hygienically resalable condition.

For statutory returns involving defective, damaged, incorrectly supplied or non-conforming goods, the product may be inspected to determine the nature of the issue.

An inspection does not remove or restrict any rights available to the consumer under applicable law.

Where a return is found not to qualify under the applicable statutory or voluntary return conditions, ABSORA™ will notify the customer and explain the outcome.

7. Return Shipping Costs

The responsibility for return shipping costs depends on the reason for the return and the applicable legal rights.

Change of mind

Where a customer voluntarily returns an unused product simply because they have changed their mind, the customer may be responsible for the direct cost of returning the product, subject to any applicable statutory cooling-off rights.

Defective or incorrect product

Where a product qualifies for a statutory return because it is defective, unsafe, incorrectly supplied or otherwise does not comply with applicable consumer rights, the return will be handled in accordance with the CPA and other applicable law.

ABSORA™ will not use this policy to shift legally required return costs to a consumer.

8. Refunds

Once a returned product has been received and assessed, ABSORA™ will process any refund that is due in accordance with the applicable legal requirements and the circumstances of the return.

Refunds will generally be made using the original payment method where reasonably possible.

The time for the funds to reflect in your account may depend on your payment provider or financial institution.

ABSORA™ is not responsible for delays caused solely by a bank, payment processor or other third-party financial institution.

Where a refund is legally required, nothing in this policy limits the applicable statutory timeframe.

9. Promotional and Discounted Orders

Products purchased during promotions, sales or discount campaigns remain subject to the same applicable consumer rights as products purchased at full price.

A discount or promotional price does not remove statutory rights relating to defective, unsafe, incorrectly supplied or otherwise non-conforming goods.

Any additional promotional return conditions will only apply to the extent that they are permitted by South African law.

10. Abuse, Misuse and Normal Wear

A return or refund may not be available where a product has been damaged as a result of:

  • Incorrect use;

  • Failure to follow reasonable care or washing instructions;

  • Negligence;

  • Deliberate damage;

  • Unauthorised modification or alteration;

  • Accidental damage caused after delivery;

  • Excessive force or improper handling; or

  • Normal wear and tear that would reasonably be expected from ordinary use.

This does not affect any statutory rights where the underlying issue constitutes a defect or failure covered by applicable consumer law.

11. No Unlawful Exclusion of Consumer Rights

ABSORA™ does not intend to exclude or limit any consumer right that cannot lawfully be excluded or limited.

If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail and the remaining provisions of this policy will continue to apply to the extent permitted by law.

12. Fraudulent or Abusive Returns

ABSORA™ reserves the right to investigate suspected fraudulent, dishonest or abusive return claims.

This may include situations involving:

  • False claims that a product was defective;

  • Products returned in a materially different condition from the condition in which they were supplied;

  • Deliberate damage;

  • Repeated abusive return activity; or

  • Attempts to obtain refunds through dishonest means.

Any action taken by ABSORA™ in such circumstances will remain subject to applicable South African law.

13. Your Statutory Rights

This policy is intended to work alongside, and not replace, your rights under South African law.

Your statutory rights may include rights arising under the:

  • Consumer Protection Act 68 of 2008;

  • Electronic Communications and Transactions Act 25 of 2002; and

  • Other applicable South African legislation.

For example, the CPA provides an implied warranty of quality and specific remedies for goods that fail to meet the statutory requirements.

The ECTA also requires online suppliers to make their return, exchange and refund policy available to consumers and provides specific cancellation rights for qualifying electronic transactions.
